This document describes the rules, rights, & responsibilities of those participating in the use of Incidnt

Welcome

We know you may not like reading too much, but the words in this document are important. By using Incidnt (or the "Site"), you are agreeing to the terms and conditions as explained below and all provisions of this document. If you do not agree, please do not use Incidnt and contact us regarding any concerns.

Description

Incidnt provides a service to help individuals securely communicate information pertaining to incidents of concern. It allows organizations to engage, update and track this information to help make their spaces safer. Delivery of this service may require the collection and use of personal information & transactional data.

Definitions

  • The User: The individual(s) submitting a report; and the administrator(s) receiving report information
  • The Organization: The organization configuring the service for use in their community
  • Incidnt: Us, we build and provide the service to make this happen
  • The Service: The process by which information is submitted, collected, delivered, and managed by Users and Organizations
  • The Terms: This document

Rights & Responsibilities

Users

  • Information and files that you provide for the purpose of submitting a report will be transmitted to the organization and associated administrator accounts for which it is intended
  • Non-identifiable information that you provide will be made available to similar organizations for the purpose of data analysis
  • Personal information will never be transmitted without your consent
  • Administrators will investigate each report in a timely fashion and according to local protocol
  • You will not use Incidnt for any illegal, unauthorized, or otherwise malicious purpose
  • In using the Service, you will not violate any laws in your jurisdiction

Organizations

  • All organizations will be verified before appearing in the Service
  • Organizations are responsible for the verification and management of additional administrator accounts
  • Non-identifiable report information will be made available to similar organizations for the purpose of data analysis
  • Local protocol for the response to and handling of reports will be implemented
  • Financial transactions are processed securely through the Site using Stripe
  • You will not use Incidnt for any illegal, unauthorized, or otherwise malicious purpose
  • In using the Service, you will not violate any laws in your jurisdiction
  • Any illegal information transmitted through the Service will be brought to the attention of the appropriate authorities

Incidnt

  • Incidnt will take appropriate steps to ensure every Organization is verified prior to appearing in the Service
  • We will create a recognizable Incidnt URL for verified Organizations
  • We will address any User's and/or Organization's request for support in a timely manner
  • Incidnt will not transmit personal information without the User's consent
  • Incidnt will not sell the User's information to advertisers
  • We reserve the right to collect and utilize non-identifiable information for the purpose of improving the Service
  • We will not monitor or alter the personal information transmitted in incident reports.
  • Incidnt may disclose personal information to the extent that it is required to do so by law, in connection with any legal proceedings or prospective legal proceedings, and in order to establish, exercise or defend its legal rights
  • We reserve the right to change any aspect of the Service, with fair notice
  • Incidnt may update the Terms of Service at any time, with fair notice

The Finer Details

Acceptance

The Terms of Service as described in this document constitute a legally binding agreement between you, the User and/or Organization, and Incidnt. These terms govern access to and the use of the Service and all information offered thereon. Your use of the Service is an agreement to the Terms of Service.

Modifications

Incidnt may modify the terms of service at any time, with fair notice. Any changes will be effective upon the posting of the updated document to this URL. You should check this page periodically to ensure you are familiar with any changes. Continued use after any modifications indicates acceptance of the changes to the Terms of Service.

Any modifications or new features added to the Service after initial access by the User and/or Organization will be governed by the Terms of Service unless specifically stated otherwise.

Registrations

In the process of creating an account, you agree to:

  • Provide accurate and complete information about yourself and/or organization, as requested in all steps of the registration process
  • Securely retain the information necessary for account access
  • Promote proper use of Incidnt among members of your community using provided resources and adhering to brand guidelines

Incident Reports

In the process of submitting an incident report, you agree to:

  • All information transmitted is accurate and free of malicious intent
  • Securely store and retain the generated incident key and self-established password
  • Monitor the incident status and provide follow-up information in a fair and just manner

In the process of receiving an incident report, you agree to:

  • Ensure information transmitted is accurate and free of malicious intent
  • Update the incident status and provide follow-up information in a fair and just manner
  • Adhere to the local protocols at your organization that govern the knowledge of and/or receipt of sensitive information

Media Uploads

Any files uploaded in the process of report submission are done so by Users. Incidnt does not claim ownership of these files and makes no representations that it does. Incidnt does not monitor the content of uploaded files, with the exception of file type and file size. In the event that a file is brought to Incidnt's attention for any reason, we will take the appropriate steps to ensure the claim is addressed and will do so in accordance with the law.

Fees

It is free to join and use Incidnt. We do charge a fee for optional administrator services, but never to individuals submitting reports. Changes to the ways Incidnt charges fees are effective after we have provided fair notice to all users. You are responsible for paying all fees and taxes associated with your use of the Service.

Payments made through the Service are done so using Stripe, a third-party payment processor. Incidnt is not responsible for Stripe's services.
